Results of the meeting of the High Qualification Commission of Judges of Ukraine in plenary session of December 21, 2023

The plenary session of the High Qualification Commission of Judges of Ukraine was attended by 13 members of the Commission: Ruslan Sydorovych, Mykhailo Bohonis, Liudmyla Volkova, Vitalii Gatselyuk, Roman Kydysiuk, Nadiia Kobetska, Oleh Koliush, Ruslan Melnyk, Oleksii Omelyan, Andrii Pasichnyk, Roman Sabodash, Serhii Chumak, Halyna Shevchuk.

The High Qualification Commission of Judges of Ukraine included in the agenda of the meeting the issue of taking response measures regarding information on possible russian citizenship of the Chairman of the HQCJ Roman Ihnatov.

After considering this issue, the Commission members decided:

To establish a working group to verify information on possible russian citizenship of the Chairman of the High Qualification Commission of Judges of Ukraine Roman Ihnatov.

To delegate the following Commission members to the working group: Roman Sabodash, Oleksii Omelian and Andrii Pasichnyk.

To invite public organisations that participated in the meeting of representatives of public organizations to appoint members of the Public Integrity Council to delegate three representatives to the working group.

To address the Security Service of Ukraine, the Foreign Intelligence Service of Ukraine, the Defence Intelligence of the Ministry of Defence of Ukraine, the State Bureau of Investigation, the Office of the Prosecutor General of Ukraine, the Ministry of Foreign Affairs of Ukraine with requests for information confirming or denying the russian citizenship of the Chairman of the High Qualification Commission of Judges of Ukraine Roman Ihnatov.

To approve the text of the Commission’s public announcement.

  1. The High Qualification Commission of Judges of Ukraine, having considered the issues of upholding the decisions of the Commission’s Panels adopted within the procedure of qualification evaluation of judges of local and appellate courts for the correspondence to the position held, decided:
    1. To uphold the decision of the High Qualification Commission of Judges of Ukraine as part of the Panel of November 27, 2023, № 24/ko-23 on the correspondence of the judge of the Oleksandrivskyi Raion Court of Donetsk Oblast Alina Shynkarenko to the position held.

To make a recommendation to the High Council of Justice on the appointment of Alina Shynkarenko as a judge of Oleksandrivskyi Raion Court of Donetsk Oblast.

    1. To uphold the decision of the High Qualification Commission of Judges of Ukraine as part of the Panel of November 13, 2023, № 4/ko-23 on the correspondence of the judge of the Dzerzhynskyi Town Court of Donetsk Oblast Yevhen Kachalenko to the position held.

To make a recommendation to the High Council of Justice on the appointment of Kachalenko Yevhen Kachalenko as a judge of Dzerzhynskyi Town Court of Donetsk Oblast.

    1. To uphold the decision of the High Qualification Commission of Judges of Ukraine composed of the Panel of July 24, 2019, № 660/ko-19 on the correspondence of the judge of Ivankivskyi Raion Court of Kyiv Oblast Anatolii Korchkov to the position held.
    2. To uphold the decision of the High Qualification Commission of Judges of Ukraine as part of the Panel of November 27, 2023, № 27/ko-23 on the correspondence of the judge of the Ustynivskyi Raion Court of Kirovohrad Oblast Svitlana Atamanova to the position held.

To make a recommendation to the High Council of Justice on the appointment of Svitlana Atamanova as a judge of the Ustynivskyi Raion Court of Kirovohrad Oblast (consideration of this issue was held without the participation of the Commission members Liudmyla Volkova and Ruslan Sydorovych).

    1. To postpone to January 29, 2024 the consideration of the issue concerning the judge of the Commercial Court of Kyiv City Inna Otrosh (consideration of this issue was held without the participation of the Commission members Liudmyla Volkova, Nadiia Kobetska, Ruslan Sydorovych).
  2. The High Qualification Commission of Judges of Ukraine decided to recommend Iryna Teslenko for appointment as a judge of the Kreminskyi Raion Court of Luhansk Oblast (consideration of this issue was held without the participation of the Commission members Liudmyla Volkova, Nadiia Kobetska, Ruslan Sydorovych).
  3. The High Qualification Commission of Judges of Ukraine decided to recommend Vadym Khodko for appointment as a judge of the Kuibyshevskyi Raion Court of Zaporizhzhia Oblast (consideration of this issue was held without the participation of the Commission members Liudmyla Volkova, Nadiia Kobetska, Ruslan Sydorovych).
  4. The High Qualification Commission of Judges of Ukraine decided to recommend Vitalii Danchuk for appointment as a judge of the Luhynskyi Raion Court of Zhytomyr Oblast (consideration of this issue was held without the participation of the Commission members Liudmyla Volkova, Nadiia Kobetska, Ruslan Sydorovych).
  5. The High Qualification Commission of Judges of Ukraine has decided:

To approve the Regulation on Compiling and Maintaining the Dossier of a Judicial Candidate in electronic form.

To declare the Regulation on Compiling and Maintaining the Dossier of a Judicial Candidate, approved by the decision of the High Qualification Commission of Judges of Ukraine dated November 15, 2016, № 150/zp-16, invalid and not applicable to the Regulation on Compiling and Maintaining the Dossier of a Judicial Candidate in electronic form (consideration of this issue was held without the participation of the Commission members Liudmyla Volkova, Nadiia Kobetska, Ruslan Sydorovych).

  1. The High Qualification Commission of Judges of Ukraine has decided:

To approve the Examination Programme and taxonomic characteristics of anonymous written testing during the qualification evaluation of judges and candidates for the position of a judge of the High Anti-Corruption Court.

To approve the Examination Programme and taxonomic characteristics of anonymous written testing during the qualification evaluation of judges and candidates for the position of a judge of the Appeals Chamber of the High Anti-Corruption Court (consideration of this issue was held without the participation of the Commission members Liudmyla Volkova, Nadiia Kobetska, Ruslan Sydorovych).

The High Qualification Commission of Judges of Ukraine included in the agenda of the meeting the issue of providing clarifications on filling in paragraphs 15 and 16 of the declaration of integrity of a judge (candidate for the position of a judge).

Following consideration of this issue, the Commission decided to provide clarifications regarding the declaration of statements in paragraphs 15, 16 of the judge’s declaration of integrity (a similar statement is contained in paragraphs 15, 16 of the candidate’s declaration of integrity) (consideration of this issue was held without the participation of the Commission members Liudmyla Volkova, Nadiia Kobetska, Ruslan Sydorovych).

The High Qualification Commission of Judges of Ukraine included in the agenda of the meeting the issue of providing clarifications on filling in the declaration of family ties of a judge (candidate for the position of a judge).

Following consideration of this issue, the Commission decided to provide clarifications on filling in the declaration of family ties of a judge (candidate for the position of a judge) (consideration of this issue was held without the participation of the Commission members Liudmyla Volkova, Nadiia Kobetska, Ruslan Sydorovych).
