Commission members participated in the International Scientific and Practical Conference “Legal Conflicts in the Application of Fundamental Rights and Freedoms”

On May 31, 2024, the International Scientific and Practical Conference “Legal Conflicts in the Application of Fundamental Rights and Freedoms” was held in Lviv, organized jointly by the Supreme Court and the OSCE Support Program for Ukraine within the framework of the Project “Assisting the Supreme Court and higher courts in implementing judicial reform and ensuring access to justice in times of war”.

Representing the High Qualification Commission of Judges of Ukraine were Deputy Chairman of the Commission Ruslan Sydorovych, Secretary of the Second Chamber Serhii Chumak and Commission member Roman Kydysiuk. 

The Conference was devoted to the issues of conflicts between fundamental rights in different legal regimes: EU law and national constitutions.

It was about individual decisions that violate fundamental rights and freedoms in the context of national constitutions, EU law, and ECHR case law.

Participants had the opportunity to discuss European recommendations on judicial proceedings and judicial integrity, as well as European integration processes in the justice sector.

The event united a wide range of representatives of the Ukrainian judicial community and foreign experts. The Conference was attended by the Chairman of the Administrative Court of Cassation within the Supreme Court Mykhailo Smokovych, judge of the Administrative Court of Cassation within the Supreme Court and Vice President of the All-Ukrainian Association of Administrative Judges Natalia Blazhivska, Head of the Eighth Administrative Court of Appeal Oleh Zaverukha, Head of the Council of Judges of Ukraine Bohdan Monich, member of the High Council of Justice Oleksandr Sasevych, Head of the Lviv Regional Military Administration Maksym Kozytskyi, Rector of the Ivan Franko National University of Lviv Volodymyr Melnyk, President of the All-Ukraine Association of Administrative Judges, President of the High Administrative Court of Ukraine in 2004–2011 Oleksandr Paseniuk.

European colleagues also spoke at the conference: President of the Association of European Administrative Judges Sylvain Mérenne, Vice-President of the Association of European Administrative Judges (2014-2023), Judge of the Administrative Court of Vienna Edith Zeller, Component Lead Support to EU Integration Process in the Justice Sector of the EU Project “Pravo-Justice”, Judge of the Court of Justice of the European Union (2016-2023) Virgilijus Valančius, the Deputy Head of the District Court of Amsterdam for International Cooperation and Rule of Law, member of the Dutch Council for the Judiciary Esther De Rooij.
