      OF THE HIGH QUALIFICATION COMMISSION OF JUDGES OF UKRAINE

Procedures of the judicial career

Competition to local administrative courts

The Commission, sitting as a panel, considered the issue of admitting candidates for judicial positions and judges included in the reserve for filling vacant judicial positions in local administrative courts to participate in the competition for 272 vacant positions of judges in local administrative courts.

By the Commission’s decisions of 7, 10 and 14 September 2026, 263 persons were admitted to participate in the competition, while 3 persons were refused admission.

On 17 September 2026, the ranking of participants in the competition for 272 vacant positions of judges in local administrative courts, announced by the Commission on 4 August 2026, was formed:

  • 242 candidates and judges selected vacant positions in local administrative courts;
  • 21 participants failed to appear or refused to participate in the competition.

Following the formation of the ranking of competition participants, it was established that the competition had not taken place in respect of 30 judicial positions in local administrative courts, as no candidates expressed their intention to take up the respective judicial positions.

The Commission ensured the openness and transparency of the ranking formation procedure by broadcasting it live on the Commission’s official YouTube channel.

On 23 September 2026, the ranking of participants was approved and the winners of the competition for vacant positions of judges in local administrative courts were determined. The successful part of the ranking included 242 participants:

- at the Vinnytsia District Administrative Court – 10 positions;

- at the Volyn District Administrative Court – 10 positions;

- at the Dnipropetrovsk District Administrative Court – 19 positions;

- at the Zhytomyr District Administrative Court – 12 positions;

- at the Zakarpattia District Administrative Court – 5 positions;

- at the Zaporizhzhia District Administrative Court – 3 positions;

- at the Ivano-Frankivsk District Administrative Court – 7 positions;

- at the District Administrative Court of Kyiv City – 34 positions;

- at the Kyiv District Administrative Court – 20 positions;

- at the Kirovohrad District Administrative Court – 5 positions;

- Lviv District Administrative Court – 11 positions;

- Mykolaiv District Administrative Court – 2 positions;

- Odesa District Administrative Court – 19 positions;

- Poltava District Administrative Court – 6 positions;

- at the Rivne District Administrative Court – 20 positions;

- at the Sumy District Administrative Court – 3 positions;

- at the Ternopil District Administrative Court – 8 positions;

- at the Kharkiv District Administrative Court – 19 positions;

- at the Khmelnytskyi District Administrative Court – 13 positions;

- at the Cherkasy District Administrative Court – 8 positions;

- at the Chernivtsi District Administrative Court – 2 positions;

- at the Chernihiv District Administrative Court – 6 positions.

In August, the Commission conducted interviews with 30 candidates for the positions of judges at the general courts of appeal:

- 12 candidates confirmed the ability to administer justice (at the Poltava Court of Appeal – 5, at the Rivne Court of Appeal – 4, at the Kharkiv Court of Appeal – 1);

- 8 candidates will be interviewed by the plenary session of the Commission (at the Kyiv Court of Appeal – 3, at the Poltava Court of Appeal – 2, at the Rivne Court of Appeal – 2, at the Kharkiv Court of Appeal – 1).

The competition is ongoing for 254 positions in appellate general courts.

 

 

Competition to the Specialised Circuit Administrative Court and Specialised Administrative Court of Appeal

On 14 September 2026, special joint meetings of the Commission and the Expert Council commenced. During these meetings, candidates for positions of judges of the Specialised Administrative Court of Appeal had the opportunity to provide explanations regarding information that had come to the attention of the Expert Council during the collection and assessment of information, as well as to answer questions from members of the Commission and the Expert Council.

On 24 September 2026, following a joint vote of the members of the Commission and the Expert Council, 6 candidates were recognised as meeting the criteria of integrity and professional competence:

- Hlomb Yurii;

- Diska Alina;

- Kravchenko Tetiana;

- Kravchuk Valerii;

- Maistrenko Oleksandr;

- Tsarikova Olena.

Interviews with candidates for the position of judge of the Specialised Circuit Administrative Court are ongoing.

Secondments

9 notifications from the State Judicial Administration of Ukraine on secondments were received.

The issues of secondments of judges were considered:

-   to 11 courts due to an excessive caseload or the impossibility of administering justice;

- from 3 courts due to a change in the territorial jurisdiction of court cases.

The issue of early termination of judges’ secondments and their simultaneous secondment was considered in respect of 3 judges.

It was recommended to second judges to the following courts:

- Boryspil City and District Court of Kyiv Oblast (1 judge);

- Holosiivskyi District Court of Kyiv City (1 judge);

- Kyiv District Administrative Court (1 judge);

- Odesa District Administrative Court (1 judge);

- Samarskyi District Court of Dnipro City (1 judge);

- Sumy District Court of Sumy Oblast (1 judge);

 

 

Qualification assessment

for suitability of a judge for his/her position held and in connection with the imposition of a disciplinary sanction

Following the qualification evaluation, Kobzar Yurii, judge of the Rubizhne City Court of Luhansk Oblast, was recognised as suitable for the position held.

The qualification assessment for suitability for the position held was terminated in respect of 3 judges due to their dismissal from office:

- Aleksieiev Andrii, a judge of the Commercial Court of Mykolaiv Oblast;

- Zelenina Nataliia, a judge of the Commercial Court of Mykolaiv Oblast;

- Petrenko Nataliia, a judge of the Sviatoshynskyi District Court of Kyiv City.

 

 

Data on the accounting of judges’ positions

The following data are included in the accounts:

on the establishment of 35 new vacant positions of judges:

in local courts - 33:

  • local general courts – 26 (resignation [9]; on voluntary basis [1]; appointment to the positions of appellate court judges [16]);
  • local administrative courts – 3 (appointment to the positions of appellate court judges);
  • local commercial courts – 4 (appointment to the positions of appellate court judges).

 

in courts of appeal – 2:

  • general court of appeal – 2 (resignation [1], appointment to the positions of appellate court judges [1]);

  • on selection and appointment of judges – 18;

  • on verification of declarations of family ties and integrity of a judge (candidate for the position of a judge) – 30;

  • on conduction of competition for filling vacant positions of judges in the high specialised courts – 18;

Participation in the events

3 September 2026 – working meeting with representatives of the Ministry of Economy and Environment of Ukraine to discuss progress in implementing steps 3.15 and 3.16 of the Ukraine Plan.

18 – 28 September 2026 – participation in training within the framework of the Rule of Law Academy organised by the British Institute of International and Comparative Law, held in London, United Kingdom of Great Britain and Northern Ireland.

23 September 2026 – working meeting of members of the High Qualification Commission of Judges of Ukraine and staff members of its Secretariat with representatives of the EU Project “PravoJustice4EU” to outline priority areas of cooperation between the Commission and the Project.

Litigation

The Commission’s interests were represented at 35 hearings of the Supreme Court.

The Administrative Cassation Court within the Supreme Court delivered the following judgments in favour of the Commission:

  1. In cases No. 990/168/26 upon the claim of Yu.V. Liashenko; No. 990/336/26 upon the claim of R.S. Rizunov; No. 990/176/26 upon the claim of O.V. Ilova; and No. 990/498/25 upon the claim of S.Ya. Nalyvaiko, concerning the recognition of decisions as unlawful and the obligation to take certain actions (selection procedure: qualification examination, cognitive abilities testing, practical assignment).
  2. In case No. 760/30163/21 upon the claim of O.B. Liashko concerning the protection of honour, dignity and business reputation.
  3. In case No. 990/322/26 upon the claim of M.V. Heiets and No. 990/604/25 upon the claim of K.V. Batrak, concerning the recognition of decisions as unlawful and their annulment, as well as the obligation to take certain actions (competition to appellate courts: interview).
  4. In case No. 990/229/25 upon the claim of V.V. Mokhonko, concerning the recognition of decisions as unlawful and their annulment, as well as the obligation to take certain actions (competition to appellate courts: qualification exam).

By rulings of the Grand Chamber of the Supreme Court:

  • in case No. 990/517/25 upon the claim of Ye.O. Savenkov, the claimant’s appeal was dismissed and the judgment of the court of first instance was upheld unchanged (selection procedure: qualification examination, cognitive abilities testing);
  • in case No. 990/440/25 upon the claim of V.V. Boiuky, the claimant’s appeal was dismissed and the judgment of the court of first instance was upheld unchanged (access to public information);
  • in cases No. 990/385/25 upon the claim of Ya.P. Yakymenko; No. 990/327/25 upon the claim of I.S. Sheviakov; and No. 990/341/25 upon the claim of T.O. Zaiets, the Commission’s position was upheld, including in cases where the Commission had lodged an appeal: the appeal was allowed, the judgment of the court of first instance was set aside, and a new judgment was delivered dismissing the claim, while the claimants’ appeals were dismissed (competition to appellate courts: interview);
  • in cases No. 990/207/25 upon the claim of V.V. Sahaidak and No. 990/154/25 upon the claim of O.H. Koteniov, the claimants’ appeals were dismissed and the judgments of the court of first instance were upheld unchanged (competition to appellate courts: qualification exam);
  • in cases No. 990/77/25 upon the claim of O.A. Ryzhyi; No. 990/43/24 upon the claim of O.V. Izovitova-Vakim; and No. 990/404/24 upon the claim of A.P. Ivasivka, the judgments of the court of first instance were set aside and the proceedings in the cases were closed (qualification evaluation for compliance with the position held).
