A submission was made with a recommendation to second a judge to the Chervonozavodskyi District Court of Kharkiv City

On October 25, 2023, at the meeting of the Second Chamber of the High Qualification Commission of Judges of Ukraine, the issue of submitting a submission with a recommendation for the secondment of Andrii Lytvynov, a judge of the Kupiansk City District Court of Kharkiv Region, was considered.

The Commission decided to submit to the High Council of Justice a submission with a recommendation to second Judge Andrii Lytvynov of the Kupiansk District Court of Kharkiv Region for a one-year secondment to the Chervonozavodskyi District Court of Kharkiv Region.

By its decision of April 20, 2023, the High Council of Justice, taking into account the inability of courts to administer justice during martial law, changed the territorial jurisdiction of the Kupiansk District Court of Kharkiv Region to the Chervonozavodskyi District Court of Kharkiv.

In accordance with the second paragraph of the first part of Article 55 of the Law of Ukraine “On the Judiciary and the Status of Judges” during the period of the state of emergency or martial law and subject to a change in the territorial jurisdiction of court cases pending in the relevant court, in the manner provided for by Part Seven of Article 147 of this Law, a judge of a court whose territorial jurisdiction of cases changes may, without his consent, be seconded for the administration of justice to the court that determines the territorial jurisdiction of cases that were pending in the court in which the judge works, and in the event that there are no vacancies in this court – to another court of the same level and specialization.
